Privacy Policy

This page explains what data we collect on dataquimbaya.com, what we use it for, and what rights you have over it. Written in plain English, no unnecessary legalese.
Who we are
Data Quimbaya is the trade name of DataQuimbaya, LLC, a limited liability company registered in Wyoming, United States, with its address at 1021 E Lincolnway, Cheyenne, WY 82001, operated by Lizandro Ruiz. For any privacy-related questions, see the contact section at the bottom of this page.
What we collect
When you fill out the contact form at /contact: your name, email, company, and the description of the process you want to automate. When you message our WhatsApp: the history of that conversation, your number, and your profile name; the conversation may be handled by an automated AI agent. When you browse the site: anonymous usage metrics via Vercel Analytics, plus advertising measurement pixels (TikTok and Meta technologies) that help us know whether our ads work.
What we use it for
The contact form is used to reply to you personally and, if it makes sense, schedule an assessment. Anonymous metrics help me understand what works on the site and what doesn't. We do not sell data to third parties. We don't add you to automated mailing lists. If you want recurring content, you'd have to subscribe explicitly.
Where your data lives
The site is hosted on Vercel (USA). The contact form sends data to an n8n webhook under our control, which forwards it to hello@dataquimbaya.com (Google Workspace). Depending on how you interact with us, your information may also live in: HubSpot (CRM), Cal.com (call scheduling), PayPal (payments), and the WhatsApp/Meta and ElevenLabs infrastructure when you talk to our agent.
How long we keep it
Form messages: 24 months from your last contact, unless you ask us to delete them sooner. Anonymous usage metrics: according to Vercel Analytics' default retention (typically 12 months).
SMS messaging and your phone number
If you agree to a meeting during a phone call with us and give us your mobile number to receive the confirmation, we use SMS to confirm, remind you about, or reschedule that meeting. This section covers only that messaging program.
- What we collect: your mobile phone number, your name, the date and time of the meeting, the date of the call in which you gave consent (and its recording), and the delivery status of each message, including any STOP or HELP reply.
- What we use it for: sending the confirmation, the reminder, and, if needed, the rescheduling notice for the meeting you agreed to, and keeping a record that you consented. Nothing else.
- No sharing: information collected through SMS, including phone numbers and SMS consent, is NOT shared with, sold to, rented to, or transferred to any third party or affiliate for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties.
- Delivery provider: messages are delivered through Twilio, our SMS provider, which processes your number only to deliver messages on our behalf and may not use it for its own purposes.
- How long we keep it: your number and meeting details for the duration of our relationship with you and up to 24 months after the last message. The record of your consent (call date and recording) for up to 4 years after the last message, so we can demonstrate consent if a carrier or regulator asks. STOP requests are kept indefinitely so that we never message that number again.
- How to opt out and request deletion: reply STOP to stop receiving messages immediately. To request deletion of your number and the related records, email lizandro@dataquimbaya.com or follow the steps on the Data deletion page linked in the site footer. We respond within 15 days.
Your rights
Under Colombia's Ley 1581 of 2012 and California's CCPA, you have the right to: access the data we have on you, correct it if wrong, ask us to delete it, and request that we export it. To exercise any of these, email hello@dataquimbaya.com and I'll respond within 15 days. To delete your data you can also follow the steps on the Data deletion page, linked in the site footer.
Changes to this policy
If we change anything material, we update the date at the top and, where applicable, notify you by email if you've contacted us previously.
